The Bombay High Court stated that it is extremely difficult to accept the police version of the sexual assault case in Badlapur, stating that it “cannot be termed as an encounter.”
Case of the Badlapur sexual assault: On Wednesday, the Bombay High Court criticised the Maharashtra Police for the detention death of Akshay Shinde, the accused in the Badlapur sexual attack, stating that it seemed like foul play and that an unbiased investigation was required into the matter.

Justices Revati Mohite Dere and Prithviraj Chavan, who make up the division bench, stated that they would be forced to issue relevant directions if they concluded that the investigation was not being conducted correctly.

What High Court said?

The investigation into the death of the accused in the sexual assault case in Badlapur should be carried out fairly and impartially, according to the Bombay High Court.

The high court also pointed out that Akshay Shinde’s shootout may have been prevented and questioned why the police had not attempted to subdue him first.

The Bombay High Court questioned, “Why was the accused shot in the head directly and not in the legs or arms first?”

“The moment he pulled the first trigger the others could have easily overpowered him.

Therefore, the Bombay High Court questioned, “Why was the accused shot in the head directly and not in the legs or arms first?”

Also, “The others could have easily defeated him the moment he pulled the first trigger.” He wasn’t very strong or well-built. It is really hard to accept this. This is not what we would call an encounter, remarked Justice Prithviraj Chavan.

Moreover, in a petition filed to the Bombay High Court on Tuesday, Anna Shinde, the father of Akshay Shinde, claimed through attorney Amit Katranvare that his son was killed in a fictitious encounter and asked that a Special Investigation Team (SIT) look into the matter.

However, the public prosecutor was informed by the high court during the hearing that a physically feeble individual cannot swiftly unlatch a revolver. It stated, “It is not very easy.”

The public prosecutor told the court that the officer’s pistol was unlocked.

To that, Justice Chavan said, “It is difficult to believe this. Prima facie there seem to be issues. A common man can’t fire a pistol because it needs strength. a revolver can’t be unlocked quickly by a physically weak man. It is not very easy.”

The bench posted the matter for further hearing on October 3, by when the police would have to take a decision on the complaint submitted by Akshay Shinde’s father, seeking an FIR against the police officers concerned.

The Bombay high court also directed for all case papers to be immediately handed over to the Maharashtra Crime Investigation Department (CID), which would be conducting a probe into Shinde’s death.
